Plant a Tree With Us Terms & Conditions
Plant a Tree: Terms and Conditions
These terms and conditions govern the relationship between you (the purchaser) and us (the National Forest Company, company number 02991970 (“National Forest”, “us”, “we”) for the provision of our plant a tree experience (the “Experience”) to you.
1. Our Contract with You
The placing of an order by you constitutes your offer to purchase the Experience on these terms and conditions (as amended from time to time) but does not constitute the creation of a contract. We have complete discretion over whether to accept such an offer and reserve the right to decline to process an order for any reason whatsoever and provide a full refund.
The contract between you and us will be entered into once we have accepted your offer to purchase the Experience, have processed your order and have received payment.
2. The Gift
By purchasing an Experience you will be entitled to:
(a) receive a personalised certificate (the “Certificate”); and
(b) attend one of our tree planting events (the “Event”).
The descriptions of the Experience, the Certificate and the Event given on our website and in any other literature are only intended to present a general idea of those items and shall not be considered binding. In particular, photographs are for illustrative purposes only and do not form part of any contract between you and us.
We cannot be held responsible for any descriptions by any third parties or on any third party or agent sites.
Please note that purchasing an Experience you are only purchasing the Certificate and the right to attend an Event. You will not receive or be entitled to receive any ownership rights in any of the trees planted in the National Forest.
3. The Certificate
At the time of placing your order, you will be asked to provide certain information to produce a personalised Certificate.
Following the completion of your order and receipt of payment, you will be given a link to download your Certificate. We will ensure that the Certificate is as described on our website, is fit for purpose and is of satisfactory quality.
If you have any problems in either completing the Certificate order or accessing the link to download the Certificate, you must let us know as soon as reasonably possible by using the Contact Us form. Further information on completing your order is also available on our Plant a Tree page.
By purchasing the Experience you agree to:
(a) accept full responsibility for the message(s) you insert into your Certificate; and
(b) to not use any language or content of any kind in the Certificate which could be considered offensive, threatening, racist, abusive, defamatory, obscene, indecent, unlawful or otherwise intended to harass or distress to any third party.
We will not be liable for any wording used by you in your personalised Gift Certificate which is contrary to that permitted under these terms and conditions.
4. The Event
Public Events - All Events will be by invitation only for the purchasers of an Experience (and their invited guests).
Timing & Location – All of our Events take place within the planting season (approximately November to March) and at the location specified by us at the time of placing your order (or such other location within the National Forest as we notify you from time to time).
Instructions - All attendees at such Events must follow all reasonable instructions of our staff conducting the Event and at all times behave in a civilised and appropriate manner towards other attendees. Anyone who fails to do so will be asked to leave the Event and will not be entitled to a refund.
Travel – If an Event has to be cancelled for any reason outside of our control, we cannot be held liable for any additional costs that you have incurred including (but not limited to) travel, subsistence and any other expenses.
Parking – At the time of ordering your Event, you will be informed of how many parking spaces will be allocated to you when you attend your Event (this will be determined by the number of trees you decide to plant).
Clothing – We strongly recommend that all individuals attending an Event wear suitable clothing and footwear and also bring a spade with them. All clothing and footwear that you wear and spade that you bring with you to our Event (as well as those of your guests) must be clean. This is essential to ensure the protection and biodiversity of our woodlands.
Alterations – If you want to change which Event you are attending, you must let us know at least four weeks before the date of the Event you originally booked. We will try to accommodate you at an Event on another date. However, we cannot guarantee that we will be able to find a date that is suitable for you.
If you do not give us sufficient notice of wanting to alter your booking or try to change your booking on more than one occasion, we reserve the right to refuse your request. We will not offer you a refund in these circumstances and one of our foresters will plant the tree on your behalf.
For further information on attendance at the Event, please see our Plant a Tree with us page.
5. Price and Payment
The price of the Experience will be the price indicated on the order page when you placed your order. This price is inclusive of VAT.
We currently accept via Paypal only and you will be redirected to Paypal’s website to pay for the Experience at the time of placing your order.
6. Cancellation by You
You can change your mind and cancel the purchase of the Experience for a full refund within 14 days of placing your order with us, provided that neither you nor anyone else has attended the Event that was purchased.
Please contact us as soon as possible if you are having any issues with the Certificate or if you wish to cancel your order.
7. Cancellation by Us
If we cancel an Event either before or on the day it is due to be held because of circumstances beyond our control we will notify you of the available alternative Event(s) that you can re-book to attend.
We cannot be held liable for any costs, including (but not limited to) travel expenses or pre-booked accommodation costs incurred by you in the event of a cancellation.
We may also cancel our contract with you for the provision of the Experience at any time by writing to you if:
(a) you do not make any payment to us when it is due or any payment to us from you is returned, refunded or rejected by your Bank; or
(b) you otherwise breach these terms and conditions.
If we end the contract for any of these reasons we will refund any money you have paid in advance for the Experience we have not provided but we may deduct or charge reasonable compensation for the net costs we incur as a result of your breaking the contract.
8. Our Liability to You
We do not exclude or limit our liability to you where it would be unlawful to do so, including:
(a) for death or personal injury caused by our negligence or the negligence of our employees;
(b) for fraud or fraudulent misrepresentation; or
(c) for a breach of your legal rights as a consumer to receive products which are as described, of satisfactory quality and fit for their intended purpose.
Subject to the above, our total liability to you in respect of all other losses arising under or in connection with the provision of the Experience shall in no circumstances exceed the price paid for the Experience and any reasonably foreseeable losses you incur.
We will not be liable for any loss:
(a) resulting from you using the Certificate for a purpose other than that for which it is intended;
(b) for any damage the Certificate may cause to any of your devices or other digital content (or those of any third party);
(c) resulting from circumstances beyond our reasonable control;
(d) for any damage to the private property of you or anyone else attending an Event with you where we are not at fault; or
(e) incurred by you or any third party in the course of business.
This contract is between you and us. No other person shall have any rights to enforce any of its terms.
If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
These terms are governed by English law and you can only bring legal proceedings in respect of the products in the English courts.
